Terms of Service for Track & Boost

Welcome to Track & Boost (“we,” “our,” “us”), a SaaS platform that allows businesses to track their Google Business Profile rankings, respond to reviews, and post content to Instagram, Facebook, and your website (the “Services”). These Terms of Service (“Terms”) govern your use of the Track & Boost app and the Services provided.
By accessing or using our app, you (“you” or “User”) agree to comply with and be bound by these Terms. If you do not agree to these Terms, you must not use our Services. Please read these Terms carefully.
1. Acceptance of Terms
By using Track & Boost, you agree to these Terms of Service. If you do not agree with any of these terms, you should not use the Services.
We reserve the right to modify, update, or change these Terms at any time. Any changes to the Terms will be posted here, and your continued use of the Services constitutes acceptance of the updated Terms.
2. Services
Track & Boost provides a suite of tools for businesses to:
- Track the ranking of their Google Business Profile.
- Respond to customer reviews.
- Create and schedule posts on Instagram, Facebook, and websites.
The Services are available through our web application, and any updates or changes to the Services will be communicated via email or through the app.
3. Meta Login Dialog
As part of the authentication process, Track & Boost may use Meta’s login dialog (formerly Facebook Login) to allow users to connect their Instagram and Facebook accounts with our platform. By using this feature, you agree to the following:
- Permissions: Meta Login Dialog may ask for permissions to access certain information from your Meta (Facebook and Instagram) account. This may include your public profile, email address, and other necessary information.
- Privacy: Track & Boost will not share your Meta account credentials with third parties and will only use the information provided through the Meta Login Dialog for the purpose of providing our Services.
- Compliance with Meta’s Policies: You agree to comply with Meta’s Platform Policies and understand that misuse or violation of these policies may result in restricted or revoked access to Meta’s APIs and services. You can review Meta’s Platform Policy for more details.
4. User Responsibilities
You are responsible for maintaining the confidentiality of your account credentials (including your password) and for all activities that occur under your account. You agree to:
- Provide Accurate Information: You agree to provide accurate, current, and complete information when creating an account or using the Services.
- Maintain Security: You must notify us immediately of any unauthorized use of your account or breach of security.
5. Account Creation
To use Track & Boost, you must create an account by providing required information, including a valid email address, business details, and linking your Google Business Profile and/or social media accounts (e.g., Instagram, Facebook). You are responsible for maintaining the confidentiality of your login credentials.
6. Subscription and Payments
Track & Boost offers both free and paid plans. By subscribing to a paid plan, you agree to pay all fees associated with your subscription. Payment will be processed through a third-party payment processor, and you must provide accurate billing information.
If you do not cancel your subscription before the end of the current billing cycle, your subscription will automatically renew, and you will be billed for the next period.
7. Use of the Services
You agree not to use the Services in any way that:
- Violates any applicable law or regulation.
- Infringes on the rights of others, including intellectual property rights.
- Disrupts or interferes with the operation of the Services.
- Attempts to gain unauthorized access to the Services or any related systems.
8. Data Privacy and Protection
Your use of the Services is subject to our Privacy Policy. By using the Services, you consent to our collection, use, and sharing of your data as outlined in the Privacy Policy. This includes your Google Business Profile data, social media data, and any other data you provide during your use of the app.
Meta Data Use: When you use Meta Login Dialog to connect your accounts, we only access and store the necessary data (e.g., business profiles, posts) required for the Services. We will not use any data retrieved from Meta for any purposes other than those outlined in these Terms.
9. Intellectual Property
Track & Boost retains ownership of all intellectual property rights in the Services, including the app, website, design, and any content provided. You are granted a limited, non-exclusive, non-transferable license to use the Services for personal or business purposes in accordance with these Terms.
10. Termination
We reserve the right to suspend or terminate your access to the Services at any time, with or without cause, if you violate these Terms or engage in any activity that disrupts the Services. You may terminate your account at any time by contacting us directly or through the app settings.
11. Limitation of Liability
Track & Boost provides the Services “as is” and does not guarantee that the Services will be error-free or uninterrupted. In no event shall Track & Boost or its affiliates be liable for any direct, indirect, incidental, special, or consequential damages arising from your use of the Services.
12. Indemnification
You agree to indemnify and hold harmless Track & Boost, its employees, affiliates, and partners from any claims, damages, or losses arising from your use of the Services or your violation of these Terms.
13. Governing Law
These Terms will be governed by and construed in accordance with the laws of New Zealand. Any disputes arising from these Terms will be subject to the exclusive jurisdiction of the courts in New Zealand
14. Changes to These Terms
We may update or revise these Terms at any time. All changes will be effective immediately upon posting. We will notify you of significant changes via email or within the app. By continuing to use the Services, you accept any updated Terms.
